MCNABB ON ALTERNATIVES TO TREATY-BASED EXTRADITION
Although a majority of nations maintain some form of extradition treaty or agreement pertaining to the extradition of alleged criminals who fall outside the jurisdiction of the requesting country, this does not always guarantee that extradition will occur under the auspices of a treaty. In fact, many have become victims to extralegal techniques, which subvert the lawful extradition process. Abduction, luring and tricking, in addition to formal and informal deportations have taken place outside the scope of lawful treaty based extradition procedures. Following the events of 9/11, these techniques may increasingly be seen as justifiable ways to expedite or bypass treaty based extradition protocols.
This section, available late Spring of 2007, will provide an in-depth examination of how prosecuting countries acquire jurisdiction through third party private citizen intervention, how third party countries become involved in order to assist in the securing of jurisdiction by the requesting country, and how even between countries in which an extradition treaty is maintained, irregular apprehension of alleged criminals is condoned.
